LEGAL BASES FOR HIGH PARTICIPATION
SOYFRUTERO FASHION CLUB

1. IDENTIFICATION OF THE COMPANY ORGANIZING THE PROMOTION
The company Grupo AGF Fashion, S.L., a Spanish company with registered office located at Calle Leonardo Da Vinci, 1, 2nd floor, door 12, 04700, El Ejido, Almería, Spain, whose Tax Identification Number is B-04740981 (hereinafter “Sandía Fashion”).
The promotion (hereinafter, “the Promotion”) organized is of national scope, to be carried out through the Internet in accordance with the provisions of the participation requirements section. The purpose of this promotion is to reward users (fruteros) who register in the Club de fruteros Fashion.
This promotion will be announced via internet and letter.

2. START DATE AND END DATE OF THE PROMOTION

The Promotion (free of charge) will start on May 17, 2023 at 00.00h, and will last until December 31, 2023 or until the first 200 NEW unique registrations (greengrocers) are reached.

3. PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The participation requirements will be the following:
a. Participation will be open to those persons who, being residents in Spain and over eighteen years of age, own or work in a greengrocer’s shop where Watermelon Fashion is sold.
b. To register in the club, they should go to the website of Sandía Fashion https://www.sandiafashion.com/soyfruterofashion/.
c. By registering in the club, you agree to be included in the database of Watermelon Fashion for a limited time or request to be removed from the club.
d. Then, the Participant must fill in all fields of the registration form in the club.
e. From that moment, the Participant will participate in the promotion and will be sent his welcome gift.

4. CONDITIONS OF THE PROMOTION AND PRIZES

Each unique registration, this means a fruit shop with a unique address, will be able to participate and will be sent a welcome kit with 20 exclusive Sandia Fashion bags and a Vinyl of the brand. This will be sent to your establishment before the end of the promotion.
The gift is personal and non-transferable and cannot be exchanged for cash.
The celebration of the Promotion, as well as the awarding of the prize are subject to current tax regulations.
In addition, every 15 days a neon or a vest will be raffled among all the associates of the club until the end of stock.

5. DISQUALIFICATIONS AND PENALTIES

If it becomes evident that any of the Participants do not comply with the requirements set forth in these Legal Bases, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion and will lose all rights to the prizes awarded by virtue of this Promotion.

6. DISCLAIMER OF LIABILITY OF SANDÍA FASHION AND ITS COLLABORATING COMPANIES

By way of example, but not limited to, Sandía Fashion and its suppliers are not responsible for any loss, theft, delay or any other circumstance attributable to third parties that may affect the development of this promotion, nor are responsible for the use made by the Participant with respect to the gift you get from this promotion.
Neither Sandía Fashion nor its suppliers assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize.
In the event that this Promotion could not be carried out, either by fraud detected in it, technical errors, or any other reason not under the control of Sandía Fashion or its suppliers that affects the normal development of the Promotion, Sandía Fashion reserves the right to cancel, modify, or suspend the same, including the web page of participation.

7. PROTECTION OF PERSONAL DATA

The companies organizing this Promotion act as Joint Controllers for the processing of data arising from this Promotion, in accordance with the provisions of Article 26 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), whereby, where two or more controllers jointly determine the purposes and means of the processing, they will be considered jointly responsible for the processing.
On the one hand, will act as a company jointly responsible for the processing of data of the Participants the company AGF Fashion Group, SL, a company of Spanish nationality with registered office located at Calle Leonardo Da Vinci, 1, 2nd floor, door 12, 04700, El Ejido, Almeria, Spain, whose Tax Identification Number is B-04740981 (hereinafter “Sandia Fashion”).
In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data will be incorporated into a file, owned by Sandia Fashion, in order to manage the promotion, as well as disseminate and publicize their results, and process the delivery of the gift.
Please note that you can exercise your rights of access, rectification, cancellation, opposition, limitation of treatment, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to atencioncliente@sandiafashion.com, or by letter to the following address: Calle Leonardo Da Vinci, 1, 2nd floor, door 12, 04700, El Ejido, Almería, Spain, enclosing in both cases a copy of an identification document.
Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to file a complaint before a Supervisory Authority, in particular before the Spanish Data Protection Agency, in the event that he/she considers that the processing of his/her personal data is not in accordance with the regulations, as well as in the event that he/she does not see the exercise of his/her rights satisfied. It is for this reason that the Participant declares to have been informed of the conditions on personal data protection by accepting and consenting to the treatment.

8. CHANGES AND ACCEPTANCE

Watermelon Fashion reserve the right to modify or extend these Terms and Conditions, to the extent that does not prejudice or undermine the rights of Participants in the Promotion.
The mere fact of participating in the Promotion implies that the Participant fully accepts the conditions of these Terms and Conditions. Also, joining the club implies acceptance of the rules in social networks of Sandía Fashion.

9. APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the Participant’s city of residence shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these rules.
